HOTARARE nr. 716 din 19 iulie 2001 privind stabilirea conditiilor de introducere pe piata a ingrasamintelor chimice din productia interna si din import

    In temeiul prevederilor art. 107 din Constitutia Romaniei si ale art. 3 lit. b) din Hotararea Guvernului nr. 19/2001 privind organizarea si functionarea Ministerului Industriei si Resurselor, cu modificarile si completarile ulterioare,

    Guvernul Romaniei adopta prezenta hotarare.

    ART. 1
    Prezenta hotarare stabileste conditiile de introducere pe piata a ingrasamintelor chimice din productia interna si din import privind etichetarea, ambalarea, marcarea, limitele minime ale continutului de nutrient din ingrasamintele chimice, metodele de prelevare a probelor si tipurile metodelor de analiza.
    ART. 2
    In intelesul prezentei hotarari urmatorii termeni se definesc astfel:
    a) ingrasamant chimic - produs utilizat ca stimulator pentru nutritia plantelor, precum si pentru ameliorarea sau intretinerea proprietatilor agrochimice si biologice ale solului;
    b) ingrasaminte chimice cu pericol de autoaprindere si explozie - ingrasaminte simple pe baza de azotat de amoniu care au un continut in azot mai mare de 28%, exprimat in azot 100%;
    c) nutrient - tipul si continutul de elemente nutritive necesare plantelor si asigurate direct acestora prin compozitia ingrasamantului;
    d) elemente nutritive - elementele chimice necesare pentru cresterea plantelor;
    e) elementele nutritive principale sunt: azotul, fosforul si potasiul;
    f) elementele nutritive secundare sunt: calciul, magneziul, sodiul si sulful;
    g) microelemente - elemente nutritive oferite plantelor in cantitate redusa. In aceasta categorie sunt cuprinse: borul, cobaltul, cuprul, fierul, manganul, molibdenul si zincul. Microelementele sunt denumite si oligoelemente sau micronutrienti;
    h) introducere pe piata - actiunea de a face disponibil, contra cost sau gratuit, un produs in vederea distribuirii si/sau utilizarii.
    ART. 3
    (1) Continutul minim al nutrientilor si al microelementelor in procente de greutate, precum si alte cerinte impuse ingrasamintelor chimice in functie de tipul de ingrasamant si de metoda de obtinere sunt prevazute in anexa nr. 1.
    (2) Tolerantele privind abaterea permisa a valorii masurate fata de valoarea declarata a continutului de nutrient sunt prevazute in anexa nr. 2.
    ART. 4
    Ingrasamintele chimice in functie de starea de agregare in care se prezinta, solida sau lichida, se introduc pe piata in vrac sau in saci si, respectiv, in ambalaje adecvate pentru ingrasamintele chimice lichide.
    ART. 5
    (1) Ambalajele utilizate pentru ambalarea ingrasamintelor chimice trebuie sa respecte urmatoarele cerinte:
    a) sa fie proiectate si realizate astfel incat sa impiedice orice pierdere de continut prin manipulare, transport si depozitare;
    b) materialele din care sunt fabricate ambalajele si dispozitivele de etansare trebuie sa fie rezistente la atacul agentilor atmosferici;
    c) ambalajele si sistemele de etansare sa fie rezistente pentru a se evita orice pierdere si pentru a indeplini criteriile de siguranta in conditiile unei manipulari normale;
    d) ambalajele cu sisteme de inchidere care se reinchid in mod repetat vor fi proiectate astfel incat sa se evite orice pierdere;
    e) ambalajele inchise cu ajutorul unui dispozitiv de aspiratie vor fi proiectate astfel incat la deschidere sigiliul de fixare sau ambalajele sa se distruga ireparabil.
    (2) In cazul ingrasamintelor chimice solide se pot folosi saci cu valva.
    (3) In cazul ingrasamintelor chimice lichide se vor folosi recipienti de dimensiuni conforme prescriptiilor tehnice ale producatorului.
    ART. 6
    (1) Ingrasamintele chimice ambalate se identifica prin datele inscrise pe etichete sau pe ambalaj.
    (2) Datele de identificare pentru ingrasamintele chimice livrate in vrac sau in containere care depasesc 100 kg se mentioneaza in documente insotitoare.
    ART. 7
    (1) Cerintele impuse pentru identificarea ingrasamintelor chimice prin etichetarea si marcarea ambalajelor sunt prevazute in anexa nr. 3.
    (2) Pe ambalaje, etichete sau pe documente insotitoare se inscriu urmatoarele date referitoare la ingrasamintele chimice:
    a) datele obligatorii de identificare prevazute la pct. 1 din anexa nr. 3;
    b) datele optionale prevazute in anexa nr. 1;
    c) marca producatorului, marca comerciala a produsului, destinatia comerciala a produsului;
    d) instructiunile specifice de utilizare, indicand raporturile de dilutie, conditiile de utilizare adecvate tipului de sol si de cultura, caruia ii este destinat ingrasamantul chimic, de stocare si de manipulare a ingrasamintelor chimice; pentru ingrasamintele chimice lichide se vor preciza temperatura depozitarii si masurile necesare pentru prevenirea accidentelor in timpul depozitarii.
    (3) Datele mentionate la alin. (2) lit. c) si d) nu trebuie sa fie in contradictie cu cele mentionate la lit. a) si b) ale aceluiasi alineat, fiind separate unele de altele in mod vizibil.
    (4) Datele mentionate la alin. (2) se prezinta separat de orice alte informatii de pe ambalaje, etichete sau de pe documente insotitoare.
    ART. 8
    Metodele de prelevare a probelor de ingrasamant chimic in vederea efectuarii analizelor sunt cuprinse in anexa nr. 4.
    ART. 9
    Tipurile metodelor de analiza pentru ingrasamintele chimice sunt prevazute in anexa nr. 5.
    ART. 10
    (1) Ministerul Industriei si Resurselor va elabora in termen de 4 luni de la publicarea prezentei hotarari metodele de analiza pentru ingrasamintele chimice, mentionate la art. 9, care vor fi aprobate prin ordin al ministrului industriei si resurselor, care se va publica in Monitorul Oficial al Romaniei, Partea I.
    (2) Normele referitoare la progresul tehnic privind metodele de analize chimice vor fi aprobate prin ordin al ministrului industriei si resurselor.
    ART. 11
    Ingrasamintele chimice pot fi introduse pe piata si/sau utilizate numai in urmatoarele conditii:
    a) sa respecte cerintele tehnice prevazute la art. 3-7;
    b) sa prezinte marca "RO-INGRASAMANT" conform prevederilor prezentei hotarari, aplicata de producatorul roman sau de reprezentantul autorizat al producatorului strain dintr-un stat nemembru al Uniunii Europene, persoana juridica cu sediul in Romania;
    c) sa prezinte marca "EC FERTILIZER" aplicata de un producator dintr-un stat membru al Uniunii Europene;
    d) sa nu dauneze sanatatii oamenilor, animalelor sau mediului;
    e) in cazul ingrasamintelor chimice importate instructiunile specifice de utilizare sa fie inscrise in limba romana.
    ART. 12
    Este interzisa introducerea pe piata a ingrasamintelor chimice care nu indeplinesc conditiile prevazute la art. 11.
    ART. 13
    Pentru ingrasamintele chimice introduse pe piata cu marca "EC FERTILIZER" producatorul sau reprezentantul sau autorizat are obligatia sa prezinte organismelor de control declaratia pe propria raspundere privind continutul minim declarat al nutrientilor si continutul declarat, exprimat ca atare sau sub forma de solubilitate, al nutrientului. In cazul in care nu exista reprezentant autorizat al producatorului, importatorul are obligatia sa detina si sa prezinte organelor de control declaratia pe propria raspundere.
    ART. 14
    Pentru ingrasamintele chimice introduse pe piata cu marca "RO-INGRASAMANT", aplicata de producatorul roman sau de reprezentantul autorizat al producatorului strain dintr-un stat nemembru al Uniunii Europene, persoana juridica cu sediul in Romania va prezenta organelor de control declaratia pe propria raspundere privind continutul minim declarat al nutrientilor si continutul declarat, exprimat ca atare sau sub forma de solubilitate, al nutrientului.
    ART. 15
    Se interzice aplicarea inscriptiilor care pot fi confundate cu marca "EC FERTILIZER" sau "RO-INGRASAMANT". Marca "RO-INGRASAMANT" se va inscrie cu majuscule.
    ART. 16
    (1) Constituie contraventii, daca nu au fost savarsite in astfel de conditii incat, potrivit legii penale, sa constituie infractiuni si se sanctioneaza cu amenda de la 500.000 la 1.000.000 lei:
    a) nerespectarea prevederilor cuprinse in anexa nr. 1, privind continutul minim al nutrientilor in procente de greutate si alte cerinte impuse ingrasamintelor chimice, in functie de tipul de ingrasamant si de metoda de obtinere, precum si ingredientii esentiali;
    b) nerespectarea prevederilor cuprinse in anexa nr. 2, referitoare la tolerantele privind abaterea permisa a valorii continutului masurat fata de valoarea declarata a continutului de nutrient;
    c) nerespectarea prevederilor privind ambalarea ingrasamintelor chimice, in functie de starea de agregare, la introducerea pe piata;
    d) nerespectarea prevederilor privind datele de identificare inscrise pe ambalajele ingrasamintelor chimice sau in documentele insotitoare.
    (2) Contraventiilor prevazute la alin. (1) le sunt aplicabile dispozitiile Ordonantei Guvernului nr. 2/2001 privind regimul juridic al contraventiilor.
    ART. 17
    (1) Constatarea contraventiilor si aplicarea sanctiunilor se fac prin inspectorii directiilor generale pentru agricultura si industrie alimentara judetene, respectiv a municipiului Bucuresti, din cadrul Ministerului Agriculturii, Alimentatiei si Padurilor.
    (2) Organele de control au acces, la cerere, in depozitele producatorilor, distribuitorilor care sunt reprezentanti autorizati ai producatorilor si in depozitele importatorilor.
    (3) Pentru controlul continutului declarat de nutrient si al continutului declarat, exprimat ca forme de solubilitate a nutrientului, de catre organismele de control se aplica prevederile prezentei hotarari.
    (4) In caz de litigiu analizele chimice se vor efectua de laboratoare apartinand unei terte parti acreditate in acest domeniu.
    ART. 18
    Anexele nr. 1-5 fac parte integranta din prezenta hotarare.
    ART. 19
    Prezenta hotarare intra in vigoare la 6 luni de la publicarea in Monitorul Oficial al Romaniei, Partea I.

    *1) Fiecare colet sau sac expediat va fi prevazut pe cat posibil cu informatii tehnice completate de catre persoana responsabila cu marketingul. Aceste informatii trebuie sa indice utilizatorului modul de determinare a cantitatii si a perioadei de aplicare, in functie de tipul si de gradul de dezvoltare a culturii.


    ANEXA 1.A.2

                        INGRASAMINTE SIMPLE FOSFATICE

     Acolo unde se prescrie criteriul de dimensiune al particulelor pentru materialele constituente esentiale din ingrasamintele livrate in forma granulata (ingrasamintele enumerate la poz. 1, 3, 4, 5, 6 si 7), acesta va fi stabilit printr-o metoda analitica apropiata.

    c) Nu sunt permise tolerante in legatura cu continutul minim si maxim specificat in anexa nr. 1.

    f) Toleranta admisa referitor la continutul declarat pentru diversele forme de azot sau solubilitatile declarate ale pentaoxidului de fosfor este de 1/10 din continutul total de nutrienti luat in considerare cu un maximum de 2% (procent de masa), prevazandu-se ca acest continut total al nutrientului sa ramana in cadrul limitelor specificate in anexa nr. 1 si al tolerantelor specificate la paragraful e) de mai sus.
    Tolerantele permise la declararea continutului de calciu, magneziu, sodiu si sulf vor fi de 1/4 din continutul declarat al acestor elemente, pana la maximum 0,9% in termeni absoluti pentru CaO, MgO, Na(2)O si SO(3); de exemplu: 0,64 pentru Ca, 0,55 pentru Mg, 0,67 pentru Na si 0,36 pentru S.
    Toleranta permisa in ceea ce priveste continutul declarat de microelemente va fi:
    - 0,4% in termeni absoluti, pentru un continut de mai mult de 2%;
    - 1/5 din valoarea declarata, pentru un continut ce nu depaseste 2%.

    ANEXA 3


                                 CERINTE IMPUSE
           pentru identificarea ingrasamintelor chimice, etichetarea
                            sau marcarea ambalajelor

    1. Marcajele de identificare obligatorii
    a) Cuvintele "RO-INGRASAMANT" scrise cu majuscule.
    b) Denumirea tipului de ingrasamant chimic, in conformitate cu anexa nr. 1, si numerele care indica continutul de nutrienti, care pentru ingrasamintele complexe (compuse) vor fi in ordinea stabilita conform denumirii produsului.
    c)1. Continutul declarat pentru fiecare nutrient, inclusiv continutul declarat exprimat ca forme si/sau solubilitati, acolo unde acestea sunt specificate in anexa nr. 1.
    c)2. Continutul nutrientilor pentru ingrasamintele compuse (complexe) si simple trebuie sa fie dat sub forma de procente de masa ca numere intregi sau, acolo unde este necesar, cu o zecimala si pentru ingrasamintele compuse (complexe), in urmatoarea ordine: N, P(2)O(5) si/sau P, K(2)O si/sau K.
    c)3. Informatiile suplimentare privind componentii de fertilizare din ingrasamintele lichide vor fi exprimate in termeni aproximativ echivalenti de masa pe volum (kilograme pe hectolitru sau grame pe litru).
    c)4. Cantitatile de ingrasaminte lichide vor fi exprimate prin masa. Exprimarea cantitatilor de ingrasaminte lichide prin volume va fi optionala.
    c)5. Formele si solubilitatile nutrientilor trebuie sa fie, de asemenea, exprimate sub forma de procente de masa din ingrasamant, exceptand cazul in care anexa nr. 1 prevede explicit ca acest continut sa fie altfel exprimat.
    c)6. Nutrientii trebuie specificati atat prin cuvinte, cat si prin simbolurile lor chimice corespunzatoare [de exemplu: azot (N), fosfor (P), pentaoxid de fosfor (P(2)O(5)), potasiu (K), oxid de potasiu (K(2)O), magneziu (Mg), oxid de magneziu (MgO), sodiu (Na), oxid de sodiu (NaO), sulf (S), trioxid de sulf (SO(3)), calciu (Ca) si oxid de calciu (CaO)].
    c)7. Se poate prescrie pentru ingrasamintele introduse pe piata ca indicatia continutului de fosfor, potasiu sau magneziu sa fie exprimata astfel:
    - numai sub forma de oxid (PO, KO, MgO);
    - numai sub forma elementara (P, K, Mg); sau
    - in ambele forme simultan.
    c)8. Daca se recomanda exprimarea continutului de fosfor, potasiu si magneziu sub forma de elemente, toate referintele din anexa nr. 1, referitoare la forma oxidata, vor fi exprimate sub forma elementara, iar valorile numerice vor fi convertite, folosindu-se urmatorii factori:
    - pentaoxid de fosfor (P(2)O(5)) x 0,436 = fosfor (P);
    - oxid de potasiu (K(2)O) x 0,83 = potasiu (K);
    - oxid de magneziu (MgO) x 0,6 = magneziu (Mg).
    c)9. Se va face o declaratie cu privire la continutul numai in magneziu, sodiu si sulf pentru ingrasamintele la care se face referire in anexa nr. 1.D. daca acestea contin cel putin:
    - 2% oxid de magneziu (MgO), adica 1,2% Mg;
    - 3% oxid de sodiu (Na(2)O), adica 2,2% Na;
    - 5% trioxid de sulf (SO(3)), adica 2% S.
    c)10. Trebuie declarat continutul de calciu ce se considera a fi nutrient, numai pentru tipurile de ingrasaminte 1 si 2 listate in anexa nr. 1.D.
    Continutul de calciu al ingrasamintelor introduse pe piata se va exprima sub forma de oxid (CaO), sub forma elementara (Ca) sau sub ambele forme.
    Pentru a transforma continutul de oxid de calciu in continut de calciu trebuie folosita urmatoarea formula:
    calciu (Ca) = oxid de calciu (CaO) x 0,715.
    Continutul de calciu solubil din ingrasamintele lichide, la care se face referire in anexa nr. 1.C, ce urmeaza sa fie pulverizate foliar va fi mentionat numai daca acesta atinge minimum 8% oxid de calciu (=5,7% Ca).
    c)11. Continutul de magneziu, sodiu si sulf al ingrasamintelor introduse pe piata poate fi exprimat:
    - sub forma de oxid (MgO, Na(2)O, SO(3));
    - sub forma elementara (Mg, Na, S); sau
    - sub ambele forme.
    Se vor folosi urmatoarele formule pentru a transforma continutul de oxid de sodiu si trioxid de sulf in continut de sodiu si sulf:
    - sodiu (Na) = oxid de sodiu (Na(2)O) x 0,742;
    - sulf (S) = trioxid de sulf (SO(3)) x 0,400.
    Daca continutul de oxid este calculat, cifra obtinuta se va rotunji la cea mai apropiata zecimala.
    c)12. Marcajele obligatorii in scopuri de identificare:
    a) denumirea tipului de ingrasamant:
    - fie in concordanta cu anexa nr. 1 din prezenta hotarare cu "tipul" urmat de "continand..." si denumirile sau simbolurile chimice ale elementelor la care se face referire. Cifrele ce indica continutul elementelor pot fi urmate de cifre in paranteza pentru elementele cuprinse in anexa nr. 1;
    - fie in conformitate cu anexa nr. 1;
    b) continutul garantat al fiecarui nutrient, precum si continutul garantat exprimat ca forme si/sau solubilitati, atunci cand acestea sunt specificate in anexa nr. 1 cu privire la ingrasaminte.
    c) 13. Daca ingrasamantul contine mai multe elemente declarabile, continutul acestora va fi indicat in urmatoarea ordine: N, P(2)O(5) si/sau P, K(2)O si/sau K, CaO sau Ca, MgO si/sau Mg, Na(2)O si/sau Na, SO(3) si/sau S.
    c)14. Declararea continutului de magneziu, sodiu si sulf din ingrasamintele cuprinse in anexa nr. 1.D trebuie facuta in una dintre modalitatile de mai jos:
    - continutul total se exprima ca procent de masa din ingrasamant;
    - cand un element este total solubil in apa, va fi declarat numai continutul solubil in apa;
    - continutul total si continutul solubil in apa exprimat ca procente de masa din ingrasamant cand continutul solubil in apa este cel putin o patrime din continutul total.
    Cantitatile continute trebuie sa fie determinate in conditiile specificate in metodele analitice prevazute in anexa nr. 5.
    c)15. Continutul in unul sau mai multe dintre urmatoarele microelemente: bor, cobalt, cupru, fier, mangan, molibden sau zinc din ingrasamintele listate in anexa nr. 1.E.1 trebuie declarat in cazul in care se indeplinesc urmatoarele doua conditii:
    - microelementele sunt adaugate si prezente cel putin in cantitatile minime specificate in anexele nr. 1.E.3 si 1.E.4;
    - ingrasamintele trebuie sa satisfaca in continuare cerintele din anexa nr. 1.E.1;
    Acolo unde microelementele sunt ingrediente normale ale materiilor prime si sunt destinate sa furnizeze elementele principale si secundare, declararea acestora poate fi optionala cu conditia ca aceste microelemente sa fie prezente in cantitati cel putin egale cu cantitatile minime specificate in anexele nr. 1.E.3 si 1.E.4.
    c)16. Marcajele obligatorii pentru identificarea ingrasamintelor cu microelemente trebuie sa fie dupa cum urmeaza:
    (i) denumirea tipului de ingrasamant:
    - fie in concordanta cu anexa nr. 1.E.1;
    - sau ca tip "Amestec de microelemente", indicatie urmata de denumirea microelementelor prezente sau de simbolurile lor chimice;
    - sau in concordanta cu anexa nr. 1.E.1, cu adaugarea la denumirea tipului fie "cu microelemente", fie "cu..." urmat de denumirea microelementului sau a microelementelor prezente ori de simbolurile lor chimice.
    Numai numerele ce reprezinta continutul in elementele principale si secundare precizate in prezenta hotarare vor urma dupa denumirea tipului.
    Cand sunt prezente mai multe microelemente, acestea trebuie sa fie scrise in ordinea alfabetica corespunzatoare simbolurilor lor chimice: B, Co, Cu, Fe, Mn, Mo, Zn;
    (ii) continutul garantat cu privire la fiecare nutrient si continutul garantat exprimat ca forme si/sau solubilitati, acolo unde acestea sunt specificate in anexa nr. 1.E.1 pentru fiecare microelement prezent;
    (iii) acolo unde toate microelementele sau o parte dintre ele sunt legate chimic de o molecula organica, numele acelui element este apoi urmat de unul dintre urmatoarele calificative:
    - "chelat cu..." (numele agentului de chelare sau prescurtarea lui, astfel cum a fost stabilit in anexa nr. 1.E.5 pct. 1);
    Microelementul continut trebuie sa fie exprimat ca procente de masa, in numere intregi, sau, acolo unde este necesar, cu o zecimala, pentru ingrasamintele ce contin numai un microelement (anexa nr. 1.E.1). Atunci cand ingrasamintele contin mai multe microelemente numarul de zecimale pentru fiecare element urmeaza sa fie stabilit in anexele nr. 1.E.2, 1.E.3 si 1.E.4.
    c)17. Pe eticheta sau pe documentele ce insotesc produsele din anexele nr. 1.E.1. si 1.E.2. trebuie inscrise sub declaratiile obligatorii urmatoarele:
    "A se folosi numai in caz de nevoie. A nu se depasi rapoartele de dilutie potrivite."
    c)18. Microelementele continute in ingrasaminte trebuie sa fie declarate sub urmatoarea forma:
    - pentru ingrasamintele solide sau lichide continand numai unul dintre microelementele: B, Co, Cu, Fe, Mn, Mo, Zn, prezentate in anexa nr. 1.E.1, in acord cu cerintele declarate in coloana 6 din anexa;
    - pentru ingrasamintele (amestecuri de doua sau mai multe ingrasaminte) ce contin cel putin doua microelemente diferite, prezentate in anexa nr. 1.E.1, prin indicarea:
    - continutului total, exprimat ca procente de masa din ingrasamant; si
    - continutului solubil in apa, exprimat ca procent de masa din ingrasamant, cand solubilitatea este cel putin jumatate din continutul total.
    In cazul in care microelementele sunt total solubile in apa va fi declarat numai continutul solubil in apa.
    Continutul de microelemente din ingrasaminte trebuie sa fie determinat in conditiile prezentate in cadrul metodelor de analiza prevazute in anexa nr. 5.
    In cazul in care microelementele sunt legate chimic de o molecula organica continutul prezent in ingrasamant trebuie sa fie declarat imediat dupa continutul solubil in apa ca procent de masa din produs, urmat de unul dintre termenii "chelat cu ..." sau "complexat cu ...", in care numele moleculei organice se declara conform anexei nr. 1.E.5. Numele moleculei organice poate fi inlocuit de initialele ei.
    d) Greutatea neta sau bruta garantata.
    In cazul in care se mentioneaza greutatea bruta, trebuie indicata alaturat tara.
    e) Denumirea sau denumirea comerciala ori marca fabricii si adresa persoanei responsabile pentru comercializarea ingrasamintelor, stabilita in Romania.
    2. Cerinte pentru etichetare
    a) Etichetele sau marcajele imprimate pe ambalaj si in care sunt redate elementele mentionate la pct. 1 trebuie sa fie plasate intr-o pozitie care atrage atentia. Etichetele atasabile trebuie fixate bine, oricare ar fi sistemul folosit pentru inchiderea ambalajului. Daca acest sistem consta dintr-un sigiliu de plumb sau alt tip de sigiliu, sigiliul trebuie sa poarte numele sau marca persoanei responsabile la care se refera pct. 1 lit. e).
    b) Marcajele la care se refera pct. 1 trebuie sa fie si trebuie sa ramana nesterse si foarte vizibile.
    c) In cazul containerelor cu o cantitate de ingrasaminte ce depaseste 100 kg si al ingrasamintelor vrac, o copie a documentelor care contin marcajele de identificare va insoti marfurile si va fi accesibila pentru inspectie.

    ANEXA 4

                                     METODE
    de prelevare a probelor de ingrasamant in vederea efectuarii analizelor

    INTRODUCERE
    Prelevarea corecta a probelor este o operatie dificila, care solicita cea mai mare atentie, in scopul obtinerii unei probe reprezentative.
    Metoda de prelevare descrisa mai jos trebuie sa fie aplicata cu stricta acuratete de catre specialisti cu experienta in procedeele de prelevare conventionale.
    1. Obiective si continut
    Probele destinate unui control oficial pentru ingrasaminte, pentru calitate si compozitie vor fi prelevate in conformitate cu metodele descrise mai jos. Probele astfel obtinute vor fi considerate drept reprezentative pentru portiunile prelevate.
    2. Inspectori specializati in prelevare de probe
    Probele vor fi luate de inspectori specializati autorizati.
    3. Definitii
    Portiune prelevata - cantitate de produs constituind o unitate si avand caracteristici presupuse a fi uniforme.
    Proba increment - cantitate luata dintr-un punct, din portiunea prelevata.
    Proba agregat - amestec de probe increment luate din aceeasi portiune prelevata.
    Proba redusa - parte reprezentativa a probei agregat obtinuta printr-un proces de reducere.
    Proba finala - parte reprezentativa din proba redusa.
    4. Aparatura
    4.1. Aparatura de prelevare trebuie sa fie facuta din materiale care sa nu afecteze caracteristicile produselor ce urmeaza sa fie prelevate.
    4.2. Aparatura recomandata pentru prelevarea ingrasamintelor solide
    4.2.1. Prelevare manuala
    4.2.1.1. Cupa cu fund plat si cu pereti verticali.
    4.2.1.2. Racul de instrumentatie (sperul) cu crapatura in lung sau cu compartimente. Dimensiunile sperului trebuie sa fie apropiate de caracteristicile probei prelevate (adancimea containerului, dimensiunile sacului etc.) si cu marimea particulei de ingrasamant.
    4.2.2. Prelevare mecanica
    Poate fi folosita aparatura mecanica aprobata pentru prelevarea ingrasamintelor ce urmeaza sa fie mutate.
    4.2.3. Separator
    Aparat proiectat pentru impartirea esantionului in parti egale, ce poate fi utilizat pentru luarea probelor increment si pentru pregatirea si reducerea probelor finale.
    4.3. Aparatura recomandata pentru prelevarea ingrasamintelor lichide
    4.3.1. Prelevare manuala
    Tub deschis, sonda, sticla sau alt echipament similar pentru a lua probe la intamplare din portiunea de verificat.
    4.3.2. Prelevare mecanica
    Aparat mecanic aprobat ce poate fi utilizat la prelevarea ingrasamintelor lichide ce urmeaza sa fie mutate.
    5. Cerinte cantitative
    5.1. Proba prelevata
    Dimensiunea probei prelevate trebuie sa fie aleasa astfel incat fiecare dintre partile sale componente sa poata fi analizata.
    5.2. Probele increment

    5.2.1. Ingrasaminte solide in vrac sau Numarul minim
           ingrasaminte lichide in containere de probe increment
           ce depasesc 100 kg
    5.2.1.1. Probe prelevate ce nu depasesc 2,5 tone 7 (sapte)

    5.3. Proba agregat
    Se solicita o singura proba agregat pentru portiunea prelevata. Masa
    totala a probelor increment ce formeaza proba agregat trebuie sa nu fie
    mai mica decat urmatoarele:
    5.3.1. Ingrasaminte solide in vrac sau
           ingrasaminte lichide in containere
           ce depasesc 100 kg 4 kg
    5.3.2. Ingrasaminte solide ambalate sau
           ingrasaminte lichide in containere
          (= ambalaje) ce nu depasesc 100 kg
    5.3.2.1. Ambalaje ce depasesc 1 kg: 4 kg
    5.3.2.2. Ambalaje ce nu depasesc 1 kg: greutatea pentru
                                                    continutul a patru
                                                    ambalaje originale
    5.3.3. Proba pentru testarea
           azotatului de amoniu ingrasamant 75 kg
    5.4. Probe finale
    Proba agregat da probele finale prin reducere, daca este necesar.
    Este recomandata analiza pentru cel putin o proba finala. Masa probei
    pentru analiza nu trebuie sa fie mai mica de 500 g.
    5.4.1. Ingrasaminte solide si lichide 75 kg
    5.4.2. Proba pentru testarea azotatului
           de amoniu ingrasamant

    *1) Daca se obtine un numar fractionar, el va fi rotunjit la urmatorul
        numar intreg.
    *2) Pentru ambalajele al caror continut nu depaseste 1 kg, proba
        increment va fi continutul unui ambalaj original.

    Proba agregat va da proba finala prin reducere, daca este necesar.
    5.4.2.1. Masa minima a probei finale pentru
             testele din anexa I: 1 kg
    5.4.2.2. Masa minima a probei finale pentru
             testul din anexa II: 25 kg


    6. Instructiuni pentru prelevarea, prepararea si ambalarea probelor
    6.1. Generalitati
    Probele trebuie prelevate si preparate cat mai repede posibil, tinandu-se seama de masurile de precautie necesare pentru a se asigura ca ele raman reprezentative pentru ingrasamantul testat. Aparatura, suprafetele si containerele ce urmeaza sa primeasca probele trebuie sa fie uscate si curate.
    In cazul ingrasamintelor lichide, daca este posibil, proba prelevata va fi amestecata inainte de prelevare.
    6.2. Probe increment
    Probele increment trebuie luate la intamplare din toata proba prelevata si trebuie sa fie de dimensiuni (marimi) aproximativ egale.
    6.2.1. Ingrasaminte solide in vrac sau ingrasaminte lichide in containere ce nu depasesc 100 kg
    Trebuie facuta o impartire imaginara a probei prelevate intr-un numar de parti aproximativ egale. Un numar de parti corespunzator numarului de probe increment solicitate conform pct. 5.2 va fi ales la intamplare si cel putin o proba va fi luata din aceste parti.
    Acolo unde nu este posibila indeplinirea cerintelor pct. 5.1, cand probele de ingrasaminte vrac sau de ingrasaminte lichide in containere nu depasesc 100 kg, probele se vor lua in momentul in care proba prelevata este mutata (incarcata sau descarcata).
    In acest caz, probele vor fi preluate la intamplare de la producatori, asa cum se arata mai sus, in momentul in care acestea sunt mutate.
    6.2.2. Ingrasaminte solide ambalate sau ingrasaminte lichide in containere (= ambalaje) ce nu depasesc 100 kg
    Dupa ce s-a selectat numarul solicitat de ambalaje pentru testare, dupa cum s-a indicat la pct. 5.2, o parte din continutul fiecarui ambalaj va fi mutat din nou. Daca este necesar, probele vor fi luate separat, dupa golirea ambalajelor.
    6.3. Pregatirea probei agregat
    Probele increment vor fi amestecate pentru a forma o singura proba agregat.
    6.4. Pregatirea probei finale
    Materialul din proba agregat va fi amestecat cu atentie*1).
    Daca este necesar, proba globala va fi redusa la cel putin 2 kg fie utilizand un separator mecanic, fie prin metoda sferturilor.
    Vor fi pregatite cel putin 3 probe finale in cantitate aproximativ egala, in acord cu cerintele cantitative de la pct. 5.4. Fiecare proba va fi pusa intr-un container etans adecvat. Vor fi luate toate masurile necesare pentru a evita orice modificare a caracteristicilor probei.
    7. Ambalarea probelor finale
    Containerele sau pachetele vor fi sigilate si etichetate (eticheta va fi incorporata in partea sigilata), astfel incat acestea sa nu poata fi deschise decat cu deteriorarea sigiliului.
    8. Inregistrarea probei
    Trebuie tinut un sistem de inregistrare a fiecarei probe, permitandu-se astfel identificarea fara ambiguitati a fiecarei portiuni testate.
    9. Destinatia probelor
    Pentru fiecare portiune de proba, cel putin o proba finala va fi trimisa cat mai repede posibil la un laborator analitic autorizat sau la o institutie de testare, impreuna cu toate informatiile necesare in vederea efectuarii analizei sau testarii.
